Since the decision to approve this controversial planning application in August, Cheshire East Council, as the local planning authority, has been formally asked to review the proposals in respect of regulations relating to the LA's duty to the conservation of habitats and species and to confirm that due regard has been given to this duty when arriving at a decision. At this stage it is not known who made this formal request.
The Strategic Planning Board will, for the third time, consider the application on November the 16th with reference to these regulations and determine whether in fact the decision to approve meets the objectives enshrined in the regulations.
Chelford Parish Council made strong representations at the August meeting, objecting to the application on the grounds that the development would have a serious negative impact on the ecology of the area. The Parish Council's views remain unchanged. Both the Cheshire East Planning Officer and the Ecology Officer advised that the application should be refused, but the application was previously approved on the casting vote of the Chair.
